SECTION 1 — WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our online store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. With your permission, we may send you emails about our store, new products and other updates. With your permission we may request to follow you on various public media platforms known and hereafter. We may also use your name to view and or like your profile and User Generated Content.

SECTION 2 – CONSENT

We value your privacy and the information you consent to share in relation to our SMS marketing service. We use this information to send you text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us.

Our website uses cookies to keep track of items you put into your shopping cart, including when you have abandoned your checkout. This information is used to determine when to send cart reminder messages via SMS.
In order to access the services provided on this website, you must become a registered user.  You must complete the registration process by providing your information, as set out on our registration page.  Please refer to our Privacy Policy for information relating to our collection, storage and use of your personal information.  

You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.

On registration, you will be required to provide a password and you agree to pay for our services, as set out on our website. We reserve the right to suspend or terminate your access to all or any part of our website at any time, including your registration, if you breach these terms and conditions or we believe in our reasonable opinion that you are misusing our website.

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, enter a competition, complete a survey, register to our newsletter we imply that you consent to our collecting your information and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

Throughout this section the term “User Generated Content” will be used to describe your participation in publishing content on all forms of social media, email and mail known now and hereafter. By acknowledging with nature’sbasket.org.nz policy in any way shape or form on your User Generated Content, you acknowledge that you are solely responsible for the User Generated Content that you published. You are legally liable for the User Generated Content that you published including, for example, material protected by copyright, trademark, patent or trade secret law or other proprietary rights laws without permission of the author or owner or subject featured in such submission, or defamatory comments.

By actively associating naturesbasket.org.nz on User Generated Content you grant naturesbasket.co.nz the worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your uploaded User Generated Content in any manner to be determined by our sole discretion, including but not limited to our webpages, social media pages operated by us, promotional e-mails and advertisements, and in other marketing, promotional and advertising initiatives, in any media now or hereafter known.

By actively associating nature’sbasket.org.nz on your User Generated Content you hereby represent and warrant that (1) you own all rights in and to your User Generated Content, (2) if the User Generated Content is subject to third party proprietary rights, you have all necessary licenses, rights, consents, and permissions to publish the User Generated Content you publish and to grant the rights granted herein, including permission from all person(s) appearing in your User Content; (3) you and other people in your User Generated Content are not minor(s), (4) you are legally entitled to post the User Generated Content, and the use of your User Generated Content as described herein will not violate the rights, including but not limited to copyright, trademark, privacy, publicity or other proprietary rights, of any third party or any law, and (5) the User Generated Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive. You hereby release, discharge and agree to hold nature’sbasket.org.nz, and any person acting on their behalf, harmless from any liability related in any way to our use of your User Generated Content.

The User Generated Content that you publish is deemed non-confidential and we have no obligation to maintain the confidentiality of any information, in whatever form, contained in any submission, except pursuant to our respective privacy policies. By using the Services, you are consenting to nature’sbasket.org.nz collecting any personal information you provide for our use and disclosure in connection with the use of your User Generated Content as described herein. If you do not agree to the collection, use and disclosure of your personal information in this way, please do not use the Services or otherwise provide us with personal information by contacting order@naturesbasket.org.nz. Your personal information may be transferred to servers located outside the country in which you live or to affiliates or other trusted third parties based in other countries so that they may process personal information on our behalf. By using the Services or otherwise providing naturesbasket.org.nz with personal information, you agree to such collection, use, disclosure, transfer and processing of your information in accordance with the terms of these Terms, the Privacy Policy and applicable data protection laws and regulations.

naturesbasket.org.nz reserves the right to remove any User Generated Content from the Site, the Brand properties and the Services at any time, for any reason. If you believe User Generated Content residing on the Site or the Services infringes a copyright, please contact us on order@naturesbasket.org.nz.

How do I withdraw my consent?

SECTION 3 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 – SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. SECTION 5 – THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. 

So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in the United States and your transaction is processed by a payment gateway located in New Zealand, then your personal information used in completing that transaction may be subject to disclosure under New Zealand Legislation. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 – COOKIES AND OTHER TRACKING SYSTEMS

We may use cookies to personalise the website and to track your usage across our other websites. Unless we advise you otherwise, this Privacy Policy will apply to all of our websites.

SECTION 8 – AGE OF CONSENT.

By using this site, you represent that you are at least the age of consent as outlined within the Terms and Conditions of our website and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 9 – CHANGES TO THIS PRIVACY POLICY.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
